Driving Under Influence
A person is guilty of the offense of driving under the influence if the person is driving or in actual physical control of a vehicle within this state and: The person is under the influence of alcoholic beverages, any chemical substance, or any substance controlled, when affected to the extent that the person’s normal faculties are impaired;  The person has a blood-alcohol level of 0.08 or more grams of alcohol per 100 milliliters of blood; or The person has a breath-alcohol level of 0.08 or more grams of alcohol per 210 liters of breath.

Felony Driving Under the Influence / Felony DUI
Any person who is convicted of a third violation of this section for an offense that occurs within 10 years after a prior conviction for a violation of this section commits a felony of the third degree or Any person who is convicted of a fourth or subsequent violation of this section, regardless of when any prior conviction for a violation of this section occurred, commits a felony of the third degree.

Any person who is in violation of the DUI laws, who operates a vehicle; and who, by reason of such operation, causes or contributes to causing: Damage to the property or person of another commits a misdemeanor of the first degree.

Any person who is in violation of the DUI laws, who operates a vehicle; and who, by reason of such operation, causes or contributes to causing serious bodily injury to another, commits a felony of the third degree.

Any person who is in violation of the DUI laws, who operates a vehicle; and who, by reason of such operation, causes or contributes to causing the death of any human being or unborn quick child commits DUI manslaughter, and commits a felony of the second degree.

A person is guilty of the offense of boating under the influence / BUI and is subject to punishment if the person is operating a vessel within this state and:  The person is under the influence of alcoholic beverages, any chemical substance, or any substance controlled when affected to the extent that the person’s normal faculties are impaired; The person has a blood-alcohol level of 0.08 or more grams of alcohol per 100 milliliters of blood; or The person has a breath-alcohol level of 0.08 or more grams of alcohol per 210 liters of breath.
